AGREEMENT FOR RELEASE AND WAIVER OF LIABILITY
Participant ____________________________________________________________________ Address ______________________________________________________________________ _____________________________________________________________________ The above named individual (hereinafter referred to as "Participant"), desires to engage in and does hereby engage in equine activities on and off premises owned by L. Patrick and Kimberly Bienvenu DBA EquiCross, Inc. and/or Blue Creek Farms (hereinafter referred to as "Equine Activity Sponsor"), and/or lease facilities and/or services, equipment and or horses from Sponsor. For and in Consideration of the above activities and services, Participant hereby does forever and finally release, remise, acquit, satisfy and forever discharge the Equine Activity Sponsor of and from all manner of action and actions, cause and causes of action, suit, debts, dues, sums of money, bonds, billings, contracts, controversies, agreements, promises, damages, variances, judgments, executions, claims and demands whatsoever, in law or in equity, which may arise or might in the future arise or herein after may arise for or against the Equine Activity Sponsor for the Activities as stated above. I fully understand that all equestrian activities including eventing, dressage, cross-country horseback riding (including riding instruction), trail riding, jumping and foxhunting (all of which can include riding over fences, other obstacles, and steep and rough terrain) are very dangerous activities. I wish to participate in these activities knowing they are dangerous. I accept and assume all the risks of injury (including death) to me or my property. If using horse trailering / transportation services and/or equestrian boarding provided by L. Patrick and Kimberly Bienvenu, I also acknowledge that this is a dangerous activity and forever release Patrick and Kimberly Bienvenu from any claim that may arise from this service including injury, loss or death to myself or my property. I agree to provide my own insurance relative to these activities and agree that Patrick and Kimberly Bienvenu shall not be responsible for providing insurance or be liable for any damage or loss that I may incur in the event of an accident � regardless of fault. In exchange for being permitted to participate in these activities, for myself, my heirs, guardians and legal representatives, I release and agree not to make or bring any claim of any kind against Patrick and/or Kimberly Bienvenu, Blue Creek Farms, EquiCross, Inc., or its officers, directors, members, employees, or guests or any land owners. I also agree if anyone makes any claims because of any injury to me (including death), or for any damage to my property, I will keep all those released by this agreement free of any damages or costs because of those claims. I further certify that I have inspected the facilities and/or terrain, obstacles and jumps that I will be using and/or riding on and over, and will utilize such at my own risk and am fully aware of the dangers associated with this type of equine activity. This document is meant to be a full and complete release from any and all liability that may arise from participating in the above described equine activity. This release is given freely and voluntarily by the Participant. WARNINGUNDER FLORIDA LAW, AN EQUINE ACTIVITY SPONSOR OR EQUINE PROFESSIONAL IS NOT LIABLE FOR AN INJURY TO, OR THE DEATH OF, A PARTICIPANT IN EQUINE ACTIVITIES RESULTING FROM THE INHERENT RISKS OF EQUINE ACTIVITIES.
